(House Bill 382)
AN ACT concerning
Sanitary Commmissions Worcester County - Sanitary Commission
- Service Area Standards
FOR the purpose of altering providing, in Worcester County, a
certain exception to a provision prohibiting the sanitary
commission and the governing bodies of the member counties,
in considering a proposed service area, from creating or
changing a service area unless the sanitary commission finds
that the creation or change is necessary for the existing
and future public health, safety, and welfare; and generally
relating to the consideration of a proposed service area by
the sanitary commission in Worcester County and the
governing bodies of the member counties body of Worcester
County for creation or change of a service area; and making
this Act an emergency measure.
BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

9-647.
(b) In EXCEPT AS PROVIDED IN SUBSECTION (E) OF THIS
SECTION, IN considering a proposed service area, the sanitary
commission and the governing bodies of the member counties may
not create or change a service area unless they find that the
creation or change:
(1) Is necessary for the existing [and] OR future
health, safety, and welfare of the public in general; and
