CHAPTER 262

(House Bill 1642)

AN ACT concerning

Allegany County - Alcoholic Beverages Licenses - Limitation

FOR the purpose of authorizing the Allegany Board of License
Commissioners to limit the number of certain beer and light
wine and beer licenses that may be issued in Allegany
County"; repealing a certain obsolete license reference; and
providing that this Act does not affect the renewal or
transfer of an existing license in Allegany County; and
making this Act an emergency measure.

BY repealing and reenacting, with amendments,

Article 2B - Alcoholic Beverages

Section 45(d)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 2B - Alcoholic Beverages

45.

(d) (1) The board shall in its discretion direct the clerk
not to issue a license whenever in its opinion any petitioner or
petitioners is or are an unfit person or persons to be granted
such license; or in the discretion of the board when the place
for which the license is applied for is not a proper one with
reference to the public peace and general welfare of the
neighborhood or to the character of its inhabitants, due regards
being given to the number of said licenses issued for said
neighborhood as well as all specific restrictions and conditions
set forth in this article.

(2) (I) The board shall restrict the granting of the
number of those licenses designated as beer, wine and liquor
licenses Classes A[, B,] and D[,] AND BEER AND LIGHT WINE
LICENSES CLASSES A AND B so that the TOTAL number of [all three
classed thereof, inclusive,] LICENSES GRANTED IN THESE CLASSES IN
EACH OF THE LICENSE CATEGORIES shall not exceed more than one to
every 1300 persons residing in Allegany County as determined by
the last U.S. census; AND

(II) THE BOARD SHALL RESTRICT THE GRANTING OF
THE AGGREGATE NUMBER OF THOSE LICENSES DESIGNATED AS BEER AND
LIGHT WINE LICENSE CLASSES A AND D, AND BEER LICENSE CLASSES A
AND D, SO THAT THE TOTAL NUMBER OF LICENSES GRANTED IN THESE
