HARRY HUGHES, Governor

Subject to the hearing provisions of § 14-505 of this
subtitle, the Commission, on the affirmative vote of a majority
of its full authorized membership, may reprimand any licensee,
place any licensee on probation, or suspend or revoke a license
if the licensee:

(22) Is disciplined by a licensing or disciplinary
authority or convicted or disciplined by a court of any state or
country OR DISCIPLINED BY ANY BRANCH OF THE UNITED STATES
UNIFORMED SERVICES OR THE VETERANS' ADMINISTRATION for an act
that would be grounds for disciplinary action under this section;

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1986.

AN ACT concerning

Health - Liabilities and Warranties for Blood

FOR the purpose of expanding the scope of the law that limits the
liability of certain persons performing designated services
with certain blood or blood products.

BY repealing and reenacting, with amendments,

Section 18-402

Annotated Code of Maryland

(1982 Volume and 1985 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Health - General

18-402.

A LEGALLY AUTHORIZED person who obtains, processes, stores,
distributes, or uses whole blood or any substance derived from
blood for injection or transfusion into an individual for any
purpose [may not be held liable for the virus of serum hepatitis
under] IS PERFORMING A SERVICE AND IS NOT SUBJECT TO:

(1) Strict liability in tort;
