(2)  PERFORMS ONLY LIMITED LABORATORY EXAMINATIONS AS
SET FORTH BY THE SECRETARY UNDER THIS SUBTITLE'S RULES AND
REGULATIONS; AND

(3)   [ (2) Has qualified] CONTINUES TO MEET THE
REQUIREMENTS under § 17-212 of this subtitle.

17-212.

(a)  A physician [who] OR GROUP PRACTICE THAT is exempted
from the permit requirements of this subtitle shall:

(1)   [demonstrate] DEMONSTRATE satisfactory
performance in a proficiency testing program in applicable
laboratory procedures before the physician performs any medical
laboratory procedure[.]; OR

(2)  SATISFY THE REQUIREMENTS SET BY THE SECRETARY
THROUGH RULES AND REGULATIONS.

(b)  (1) The Department shall establish the standards for
demonstrating satisfactory performance in the proficiency testing
program.

(2) The Department or an organization approved by the
Secretary shall conduct the proficiency testing program.

(c)  A physician shall pay to the Department the test fee
set by the Secretary.

(d)  If a physician fails to demonstrate satisfactory
performance in a proficiency testing program, the Department
shall notify the Commission on Medical Discipline of Maryland.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1986.
