The existing cross-reference and the error in
punctuation were included in Ch. 759 of the Acts of
the General Assembly of 1968.
The cross-reference clarification was suggested by the
professional staff of the Legislative Division of the
Department of Legislative Reference. The error in
punctuation was noted by the Michie Company.
66.
(b) This subtitle does not preempt the provisions of
[Article 56, § 158] §§ 4-1112 AND 4-1212 OF THE HEALTH -
ENVIRONMENTAL ARTICLE or preempt the licensing of carnivals,
fairs, or amusement attractions by the State or other political
subdivisions.
DRAFTER'S NOTE: This corrects an outdated cross-reference
in Article 89, § 66(b).
Article 56, § 158 became §§ 4-1112 and 4-1212 of the
Health-Environmental Article in Ch. 267 of the Acts of
the General Assembly of 1982.
The outdated cross-reference was noted by the Michie

(b). The Board consists of nine members of whom one member
shall be a representative of the amusement ride manufacturers,
one shall be a representative of the carnival owners, two shall
be [a representative] REPRESENTATIVES of the amusement park
owners, one shall be a representative of the State or county
fairs, one shall be a mechanical engineer and three shall
represent the public and one of the public members shall be
designated the chairman. The members of this Board shall be
appointed by the Governor with the advice and consent of the
Senate for a term of six years, except of the first members
appointed, of those representing the amusement ride
manufacturers, carnival owners, amusement park owners and State
and county fairs, one shall be appointed for three years, one
shall be appointed for four years, one shall be appointed for
five years and one shall be appointed for six years and the
mechanical engineer and, of those members representing the
public, one shall be appointed for four years, one shall be
appointed for five years and one shall be appointed for six
years, all members to serve until their successors are appointed
and qualified and such appointments are approved by the Senate.
Vacancies shall be filled by the appointment for the unexpired
term by the Governor with the advice and consent of the Senate in
the same manner as the original appointments. The members of the
Board shall receive the compensation provided in the budget and
shall be reimbursed for actual expenses. The members of the Board
are eligible for reappointment.
