CHAPTER 141

(Senate Bill 260)

AN ACT concerning

Public Records - Retired Employees of
Law Enforcement Agencies

FOR the purpose of permitting the release of certain information
about retired employees of law enforcement agencies under
certain conditions; allowing a law enforcement agency to
obtain the address of retired employees when necessary for
certain official business; and generally relating to the
release of retirement records of former law enforcement
agency employees.

BY repealing and reenacting, with amendments,

Section 10-616(g)(2)
Annotated Code of Maryland
(1984 Volume and 1985 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - State Government

10-616.

(g) (2) A custodian shall permit inspection:

(i) by the person in interest;

(ii) by the appointing authority of the
individual; [and]

(iii) after the death of the individual, by a
beneficiary, personal representative, or other person who
satisfies the administrators of the retirement and pension
systems that the person has a valid claim to the benefits of the
individual; AND

(IV) BY ANY LAW ENFORCEMENT AGENCY IN ORDER TO
OBTAIN THE HOME ADDRESS OF A RETIRED EMPLOYEE OF THE AGENCY WHEN
CONTACT WITH A RETIRED EMPLOYEE IS DOCUMENTED TO BE NECESSARY FOR
DOCUMENTED OFFICIAL AGENCY BUSINESS.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1986.
