(a) [(1)] The head of the Administration is the
Director, who shall be appointed by the Governor with the advice
[of the Secretary] AND THE ADVICE AND CONSENT OF THE SENATE
OF MARYLAND.
(2) THE DIRECTOR SERVES AT THE PLEASURE OF THE
GOVERNOR.
[(2) The Governor shall appoint the Director from a
list of qualified individuals submitted by the Secretary of
Personnel to the Governor and the Secretary of Health and Mental
Hygiene.]
(b) The Director shall be a competent individual with
adequate training and broad, practical experience in
administration and , TO THE EXTENT POSSIBLE, EXPERIENCE in
dealing with institutions and court services for the care,
custody, and treatment of children who need these services.
[(c) (1) Each candidate for the position of director shall
take the qualifying examination that the Department of Personnel
prepares and administers.
(2) After the examination, the Secretary of Personnel
shall prepare the list of qualified individuals. The number of
names on the list shall be at least 3 and not more than 5.
(3) The Director shall be appointed and hold the
position under the State Merit System Law.]
[(d)] (B) (C) The Director is entitled to the salary
provided in the State budget.
[(e)] (C) (D) The Director shall devote full time to
official duties.
[(f)] (D) (E) (1) [With the approval of the Secretary,
the Director] THE GOVERNOR shall appoint a deputy director.
(2) The deputy director is entitled to the salary
provided in the State budget.
SECTION 2. AND BE IT FURTHER ENACTED, That it is the intent
of the Maryland General Assembly that the Director and deputy
director of the Juvenile Services Administration of the
Department of Health and Mental Hygiene shall be appointed by the
Governor and not hold the position under the State Merit System
Law.
SECTION 3. AND BE IT FURTHER ENACTED, That this Act is
hereby declared to be an emergency measure and necessary for the
