(2) (I) OUT-OF-HOME CHILD CARE" MEANS CARE OUTSIDE
OF THE CHILD'S HOME GIVEN INSTEAD OF PARENTAL CARE TO A CHILD ON
A REGULAR SCHEDULE FOR PART OF A DAY, BY WHATEVER NAME KNOWN,
INCLUDING FAMILY DAY CARE, DAY CARE CENTER, NURSERY SCHOOL,
KINDERGARTEN, BEFORE AND AFTER SCHOOL CARE, LEARNING CENTER,
CHILD DEVELOPMENT CENTER OR SUMMER CAMP.
(3) "OUT-OF-HOME CHILD CARE" DOES NOT INCLUDE
LEGALLY MANDATED PUBLIC OR NONPUBLIC ELEMENTARY, MIDDLE, OR
SECONDARY SCHOOL PROGRAMS
"CHILD CARE" MEANS ANY LICENSED CHILD CARE PROGRAM
THAT PROVIDES SERVICE FOR PART OF A DAY, INCLUDING;
(I) 1. A FAMILY DAY CARE PROVIDER;
(II) 2. A NURSERY SCHOOL;
(III) 3. A KINDERGARTEN PROGRAM; OR
(IV) 4. A BEFORE SCHOOL AND AFTER SCHOOL CARE
PROGRAM; OR
5. A GROUP DAY CARE CENTER.
(II) "CHILD CARE" DOES NOT INCLUDE A PUBLIC OR
NONPUBLIC ELEMENTARY. MIDDLE, OR SECONDARY SCHOOL PROGRAM.

(A) THERE IS AN INTERAGENCY CHILD CARE LICENSING COUNCIL.
(B) THE INTERAGENCY CHILD CARE LICENSING COUNCIL IS A PART
OF THE DEPARTMENT OF HUMAN RESOURCES FOR BUDGETARY AND
ADMINISTRATIVE PURPOSES ONLY.
9-1303.
(A) THE COUNCIL SHALL CONSIST OF:
(1) THE SECRETARY OF THE DEPARTMENT OF HEALTH AND
MENTAL HYGIENE OR A DESIGNEE OF THE SECRETARY;
(2) THE SECRETARY OF THE DEPARTMENT OF HUMAN
RESOURCES OR A DESIGNEE OF THE SECRETARY;
(3) THE STATE SUPERINTENDENT OF THE MARYLAND STATE
DEPARTMENT OF EDUCATION SCHOOLS OR A DESIGNEE OF THE
SUPERINTENDENT; AND
(4) THE PRIMARY PROGRAM MANAGERS FOR THE OUT-OF-HOME
CHILD CARE PROGRAMS IN EACH OF THE 3 UNITS.
(B) THE GOVERNOR SHALL APPOINT A CHAIRPERSON FROM THE
MEMBERSHIP ON A ROTATING BASIS.
