and Civil Defense Agency and local governments that, as a
result of Hurricane Juan and a severe rainstorm, Allegany,
Anne Arundel, Calvert, Frederick, Garrett, St. Mary's and
Washington Counties experienced within their boundaries
serious personal injuries, loss of human life and
significant destruction of property; and,

WHEREAS, This situation has resulted in the evacuation and
sheltering of persons in these counties; and,

NOW, THEREFORE Pursuant to the authority vested in me by the
Constitution and Laws of the State of Maryland, including
but not limited to Article 16A and Article 41 of the
Annotated Code of Maryland, I, HARRY HUGHES, GOVERNOR OF
MARYLAND, HEREBY PROCLAIM THAT A STATE OF EMERGENCY EXISTS
IN ALLEGANY, ANNE ARUNDEL, CALVERT, FREDERICK, GARRETT, ST.
MARY'S AND WASHINGTON COUNTIES.

EXECUTIVE ORDER OF NOVEMBER 16, 1985

MILITIA - OATHS OF ENLISTMENT OR APPOINTMENT

WHEREAS, National Guard Regulation 600-200 requires that the oath
of enlistment in the National Guard be administered by any
commissioned/warrant officer of the National Guard of the
State or jurisdiction concerned, or by any other person
authorized by the laws of the State or other jurisdiction to
administer the oath; and

WHEREAS, Article 65, Section 25 of the Annotated Code of Maryland
empowers officers of the organized militia of this State to
administer oaths of the enlistment to individuals enlisting
in the organized militia of this State; and

WHEREAS, The laws of this State do not prohibit other persons
from administering the oaths of enlistment; and

WHEREAS, On August 29, 1985, the Department of Defense required
that, effective October 1, 1985, all persons entering the
military service be processed, to include the oath of
enlistment, at a Military Entrance Processing Station; and

WHEREAS, There are no officers of the organized militia of this
State present at a Military Entrance Processing Station to
administer oaths of enlistment; and

WHEREAS, In the interest of economy and governmental efficiency,
it is desirable to permit the Adjutant General to authorize
federally recognized officers of the Armed Forces present at
