Dear Mr. Speaker:
In accordance with Article II, Section 17 of the Maryland
Constitution, I have today vetoed House Bill 816.
This bill requires the Secretary of Personnel to document in
writing that reasonable accommodations were considered before
denying a person State employment for medical reasons. The
Secretary must also state the nature of the accommodations
considered, and the reason for refusing the accommodations.
Senate Bill 239, which was passed by the General Assembly
and signed by me on May 27, 1986, accomplishes the same purpose.
Therefore, it is not necessary for me to sign House Bill 816.

AN ACT concerning
State Employment - Department of Personnel -
Medical Examination Advisory Board
Denial of State Employment for Medical Reasons
FOR the purpose of repealing certain provisions of law that
prohibit the Secretary of Personnel or prohibit an
authorizing authority from taking certain actions regarding
certain qualifications for State employment; establishing
the Medical Examination Advisory Board within the Department
of Personnel; providing for the membership of the Board;
defining terms; requiring the medical director to submit
certain information to the Board within a certain time
period after determining that a State employee or that an
applicant for State employment is unfit for a certain
position; requiring the Board to determine whether or not
certain State employees or applicants for State employment
are able to perform certain duties and functions when
provided with reasonable accomodation; requiring the Board
to report the Board's determination regarding certain
employees or applicants for State employment in writing to
the Secretary; clarifying language; requiring the Secretary
of Personnel to adopt certain rules and regulations;
requiring the Secretary of Personnel to repeal certain rules
and regulations and to consult with the Governor's Office
for Handicapped Individuals in developing certain rules and
regulations; and generally relating to the Medical
