this Act; limiting the liability of certain persons for
actions taken or statements made in the implementation of
this Act; providing that the Association need not provide
insurance under certain circumstances; and generally
relating to the creation of a Commercial Casualty (Joint

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 48A - Insurance Code

43. COMMERCIAL CASUALTY JOINT UNDERWRITING ASSOCIATION

THIS SUBTITLE SHALL BE KNOWN AS THE "COMMERCIAL CASUALTY
JOINT UNDERWRITING ASSOCIATION ACT".

599.

THE PURPOSE OF THIS SUBTITLE IS TO:

(1)  AUTHORIZE AND ESTABLISH A PROGRAM WHICH WOULD
MAKE CERTAIN COMMERCIAL CASUALTY INSURANCE AVAILABLE TO ALL
QUALIFIED APPLICANTS, WITH THE LEAST POSSIBLE ADMINISTRATIVE
DETAIL AND EXPENSE, SUBJECT TO THE CONDITIONS OF THIS SUBTITLE;

(2)  PROVIDE FOR OPERATION OF A POOL BY LICENSED

INSURERS THROUGH THE FACILITIES OF A JOINT INSURANCE AN

UNDERWRITING ASSOCIATION; AND

(3)  PUBLICIZE THE PURPOSES AND PROCEDURES OF THIS
SUBTITLE SO THAT A PERSON DOES NOT FAIL TO SEEK ITS ASSISTANCE
THROUGH IGNORANCE.

(A) IN THIS SUBTITLE THE FOLLOWING WORDS HAVE THE MEANINGS
INDICATED UNLESS THE CONTEXT REQUIRES OTHERWISE.

(B) "ASSOCIATION" MEANS THE COMMERCIAL CASUALTY JOINT
INSURANCE UNDERWRITING ASSOCIATION.
