SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

13-106.

(b)(1) The principal of the Trust Fund may be expended if:

[(1)](I) The principal of the Trust Fund does not
exceed $500,000;

[(2)] (II) An energy emergency is declared by the
Governor, as provided in Article 41, § 15B(c-1) of the Code, and
then only for purposes of subsection (a)(1) of this section; or

[(3)] (III) It is required as a condition of

acceptance of oil overcharge refunds.

(2) IF THE TRUST FUND EXCEEDS $5,000,000 IN ANY YEAR,
50 PERCENT OF THE PRINCIPAL OF THE TRUST FUND MAY BE EXPENDED.

13-103.

(b) Expenditures under this subsection shall be made
pursuant to an appropriation approved by the General Assembly in
the annual State budget, or by the budget amendment procedure
provided for in § 209 § 7-209 of the State Finance and
Procurement Article IF THE STANDING COMMITTEES LEGISLATIVE POLICY
