SERVICE WHILE ACTUALLY ENGAGING IN THE PICKUP AND DISPOSAL OF
GARBAGE AND REFUSE; AND

(II) DOES NOT PROVIDE PICKUP AND DISPOSAL
SERVICE OF CONTROLLED HAZARDOUS WASTE SUBSTANCES.

(i) The criminal penalty provisions of § 41(c) of this
subtitle do not apply to §§ 32A through 32N, inclusive, of this
subtitle.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1986.

Dear Mr. President:

In accordance with Article II, Section 17 of the Maryland
Constitution, I have today vetoed Senate Bill 1028.

This bill provides a procedure for the granting of a waiver
in Harford County of a county-approved water supply or sewerage
system requirement prior to the issuance of a building or zoning
permit in an area where a community water supply is scheduled to
be built within 10 years.

House Bill 1368, which was passed by the General Assembly
and signed by me on April 29, 1986, accomplishes the same purpose
as this bill. In its definition of minimum lot size and
percolation rate, House Bill 1368 was preferable from an
enforcement perspective. Therefore, it is not necessary for me
to sign Senate Bill 1028.
