(House Bill 1186)

AN ACT concerning

Washington Suburban Sanitary Commission - Composting Facility -

Construction and Closing
PG/MC 27-86

FOR the purpose of prohibiting the Washington Suburban Sanitary
Commission (WSSC) from constructing a composting facility
within a certain distance from homes unless certain
precautions are taken; requiring the WSSC to adopt certain
regulations under this Act; requiring the WSSC to close
certain composting facilities within a certain time if the
WSSC does not control and eliminate certain odors caused by
the facility; requiring the WSSC to make certain existing
composting facilities free of certain odors by a certain
date; and generally relating to the construction and closing
of composting facilities of the WSSC.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 29 - Washington Suburban Sanitary District

18-107.

(A)  UNLESS THE WSSC TAKES PRECAUTIONS TO MAKE A COMPOSTING
FACILITY FREE OF OFFENSIVE OFF-SITE ODORS, THE WSSC MAY NOT
CONSTRUCT THE FACILITY IN ANY AREA THAT HAS MORE THAN 100 HOMES
THAT ARE LOCATED WITHIN 5 MILES OF THE FACILITY.

(B)  THE WSSC SHALL ADOPT REGULATIONS THAT PROVIDE STANDARDS
FOR THE CONSTRUCTION AND OPERATION OF A COMPOSTING FACILITY THAT
IS FREE OF OFFENSIVE OFF-SITE ODORS.

(C)  IF THE WSSC DOES NOT CONTROL AND ELIMINATE ANY
OFFENSIVE OFF-SITE ODOR THAT IS CAUSED BY A COMPOSTING FACILITY
THAT IS CONSTRUCTED AFTER JULY 1, 1986, THE WSSC MUST CLOSE THE
FACILITY WITHIN 4 MONTHS FROM THE DATE THE OFFENSIVE OFF-SITE
ODOR IS EMITTED FROM THE FACILITY.

(D) ON OR BEFORE JANUARY 1, 1987, THE WSSC SHALL TAKE ALL
NECESSARY AND REASONABLE ACTIONS TO MAKE ANY COMPOSTING FACILITY
IN EXISTENCE ON JULY 1, 1986 FREE OF OFFENSIVE OFF-SITE ODORS.
