3388                                          LAWS OF MARYLAND                                      Ch. 840

(1)  The Transportation Selection Board shall require
uniform and consistent public announcement of requests for the
procurement of architectural or engineering services.

(2)  In addition, an announcement of each request
shall be mailed to each person that requests notification on a
specific project.

(c) Each announcement shall:

(1)   [Describe] DESCRIBE generally the architectural
and engineering services to be procured; and

(2)   [Indicate] INDICATE how interested persons may
receive information about the procurement.

[19-108.] 11-156. PUBLIC MEETING.

(a)  The Transportation Selection Board shall hold a public
meeting to accept, postpone for cause, or reject the person
recommended under the screening process of the Department OF
TRANSPORTATION to be awarded a contract for architectural
SERVICES or engineering services.

(b)  The Transportation Selection Board shall provide
reasonable and timely notice of this public meeting.

[19-109.] 11-157. REQUIREMENTS FOR AWARD; WAIVER.

(a) (1) The recommendation of the Transportation Selection
Board for the procurement and award of each contract for
architectural and engineering services costing over $100,000
shall:

(i) [Be] BE made on a competitive basis; and

(ii) [Include] INCLUDE an evaluation of
technical proposals and qualifications from [two] 2 or more
persons.

(2) (i) The transportation agency shall negotiate a
contract with the most qualified firm at a rate of compensation
that the transportation agency determines is fair, competitive,
and reasonable. In making that determination, the transportation
agency shall:

1.  Consider the scope and complexity of
the professional services required; and

2.  Conduct a detailed analysis of the
cost of the services.

(ii) If the transportation agency is unable to
negotiate a satisfactory contract with the firm considered to be
the most qualified at a price the transportation agency
