(3) The price of supplies AND SERVICES purchased from
sheltered workshops shall be set by the pricing and selection
committee for sheltered workshops.
[18-203.] 11-143. BLIND INDUSTRIES AND SERVICES PRICING
COMMITTEE.
There shall be a pricing committee for Blind Industries and
Services of Maryland. The committee is composed of four persons:
the executive vice president of Blind Industries or his designee;
a member of the executive board, or designee of the National
Federation of the Blind of Maryland, appointed by that board; the
Secretary of Public Safety and Correctional Services or his
designee; and the Secretary of General Services or his designee.
The committee shall set the prices of all supplies AND SERVICES
sold by Blind Industries. These prices shall be fixed so as to
reflect the fair market price for the supplies. The members shall
serve without compensation and shall receive assistance from the
staff of Blind Industries and Services.
11-144. STATE USE INDUSTRIES.
A STATE AGENCY SHALL PURCHASE SUPPLIES AND SERVICES FROM
STATE USE INDUSTRIES AS PROVIDED IN ARTICLE 27, §§ 680 THROUGH
681M OF THE CODE.
[Subtitle 3. Resident Business Preference.]
[18-301.] 11-145. RESIDENT BUSINESS PREFERENCE.
(a) (1) In this section the following words have the
meanings indicated.
(2) "Maryland firm" means a business entity that has
its principal office in the State.
(3) "Nonresident firm" means a business entity that
has its principal office out of the State.
(b) (1) When awarding a contract by competitive bidding, a
procurement agency shall give a percentage preference to the
lowest responsive and responsible bid from a Maryland firm over
that of a nonresident firm if the state in which the nonresident
firm is located gives a resident business preference.
(2) The percentage of preference awarded under this
section shall be the same as that awarded by the state in which
the nonresident firm is located.
(c) If in conflict with any federal grant or regulation
affecting the contract, the provisions of this section do not
apply.
