(J) "CONSTRUCTION RELATED SERVICES" MEANS FEASIBILITY
STUDIES, SURVEYING, CONSTRUCTION MANAGEMENT, CONSTRUCTION
INSPECTION, AND SIMILAR EFFORTS ASSOCIATED WITH CONSTRUCTION OR
THE ACQUISITION OF PUBLIC IMPROVEMENTS AS DEFINED IN § 4-401(D)
OF THIS ARTICLE.

[(f)] (K) (1) "Contract" means [every] AN agreement IN
WHATEVER FORM entered into by a State agency for the LEASE AS
LESSEE OF REAL OR PERSONAL PROPERTY OR THE [procurement]
ACQUISITION of supplies, services, construction, CONSTRUCTION
RELATED SERVICES, [or] ARCHITECTURAL SERVICES, OR ENGINEERING
SERVICES. [any other item and includes:

(i) Awards and notices of award;

(ii) Contracts of a fixed-price,
cost-reimbursement, cost-plus-a-fixed-fee, fixed-price incentive,
or cost-plus incentive fee type;

(iii) Contracts providing for the issuance of
job or task orders;

(iv) Leases;

(v) Letter contracts;

(vi) Purchase orders;

(vii) Supplemental agreements with respect to
any of these; and

(viii) Orders.]

(2) "Contract" does not include:

(i) A [Collective] COLLECTIVE bargaining
[agreements] AGREEMENT with AN employee [organizations; and all
agreements] ORGANIZATION OR AN AGREEMENT creating AN
[employee-employer relationships] EMPLOYER-EMPLOYEE RELATIONSHIP,
as defined in [Article 64A,] § 15A(a)(3) OF ARTICLE 64A of the
Code; or

(ii) A Medicaid, judicare, or similar
reimbursement [contracts] CONTRACT for which user OR RECIPIENT
eligibility and [cost] PRICE PAYABLE BY THE STATE are set by law
or [by rules and] regulations.

[(g)] (L) "Contract modification" means [any] A written
alteration in [the] specifications, delivery point, date of
delivery, [contract] period OF PERFORMANCE, price, quantity, or
other [provision] PROVISIONS of [any existing] A contract[,
whether] THAT IS accomplished [by unilateral action in accordance
with a contract provision, or] by mutual action of the parties to
the contract. [It includes bilateral actions such as
supplemental agreements, and unilateral actions such as change
