HARRY HUGHES, Governor 33
Article 10, § 46 was added by Ch. 723 of the Acts of
the Regular Session of the General Assembly of 1985
and immediately follows a subtitle relating to the
Legal Services Corporation.
The new subtitle was suggested by the Michie Company.
Article 23 - Miscellaneous Companies
165A.
(i) The following terms used in this section shall, for the
purpose of this section, have the following meanings:
(5) "Trustee" shall mean any national banking
association; or any bank as defined in § 15-201 of the Estates
Article of the Code; or savings bank and any building, savings
and loan association insured by an agency of the federal
government or, if located in the State, insured by the [Maryland
Savings-Share Insurance Corporation] STATE OF MARYLAND DEPOSIT
INSURANCE FUND CORPORATION; or other organization or individuals
who shall provide a fidelity bond from any recognized bonding
institution, said bond to be in an amount equal to the trust fund
and inuring to the benefit of the trust account of the cemetery
and/or its individual lot owners.
DRAFTER'S NOTE: This amends Article 23, § 165A to replace
an obsolete reference to the Maryland Savings-Share
Insurance Corporation (MSSIC) with a reference to its
successor, the State of Maryland Deposit Insurance
Fund Corporation (MDIF).
Ch. 6 of the Acts of the First Special Session of the
General Assembly of 1985 eliminated the MSSIC and
replaced it with the MDIF.
The obsolete reference was noted by the professional
staff of the Legislative Division of the Department of
Legislative Reference.
Article 27 - Crimes and Punishments
139B.
(b) The term "destructive explosive device" shall include
any explosive, as defined by Article 38A, [§ 26A] § 26(A) of the
Code, incendiary or poisonous gas incorporated into a bomb,
grenade, rocket having a propellant charge, missile having an
explosive or incendiary charge, mine, or other similar device.
DRAFTER'S NOTE: This corrects an erroneous cross-reference
in Article 27, § 139B(b).
The erroneous cross-reference was added by Ch. 344 of
the Acts of the General Assembly of 1984.
