(D) NOTWITHSTANDING THE PROVISIONS OF SUBSECTION (A) OF
THIS SECTION, UNLESS THE POLICY, CONTRACT, OR CERTIFICATE
EXPRESSLY PROVIDES FOR REIMBURSEMENT OF ANY SERVICE WHICH IS
WITHIN THE LAWFUL SCOPE OF PRACTICE OF A PHYSICIAN ASSISTANT
CERTIFIED UNDER THE HEALTH OCCUPATIONS ARTICLE, THE PROVISIONS OF
TITLE 14.5 OF THE HEALTH OCCUPATIONS ARTICLE GOVERNING THE
CERTIFICATION AND REGULATION OF PHYSICIAN ASSISTANTS MAY NOT BE
CONSTRUED TO ENTITLE THE INSURED OR ANY OTHER PERSON COVERED BY
THE POLICY, CONTRACT, OR CERTIFICATE TO REIMBURSEMENT FOR ANY
SERVICE WHICH IS WITHIN THE LAWFUL SCOPE OF PRACTICE OF A
CERTIFIED PHYSICIAN ASSISTANT.

Article - State Government

8-403.

(G) EXCEPT AS OTHERWISE PROVIDED IN SUBSECTION (E) OF THIS
SECTION, ON OR BEFORE JULY 1, 1996, AN EVALUATION SHALL BE MADE
OF THE STATE PHYSICIAN ASSISTANT ADVISORY COMMITTEE ESTABLISHED
UNDER THE HEALTH OCCUPATIONS ARTICLE AND THE REGULATIONS THAT
RELATE TO THE PHYSICIAN ASSISTANT ADVISORY COMMITTEE.

SECTION 2. AND BE IT FURTHER ENACTED, That all physician
assistants registered prior to the effective date of this Act
under regulations of the State Board of Medical Examiners shall
be deemed qualified and eligible to be certified under this Act,
provided due notice is sent by the Board to all registered
physician assistants and an application for certification is
received by the Board before July 1, 1987, and provided further
that the examination requirements for "noncertified" physician
assistants, as defined by the Board's current regulations, are
satisfied within 2 years of the physician assistant's initial
registration by the Board.
