Annotated Code of Maryland

(1981 Volume and 1985 Supplement)

Preamble

WHEREAS, It is the policy of this State that drug dispensing
by dentists, physicians, and podiatrists should be discouraged if
adequate pharmaceutical service is available; and

WHEREAS, The professional source of income of a dentist,
physician, or podiatrist, respectively, should be from the
rendering of dental, medical, or podiatry services to patients,
and only from that source; and

WHEREAS, Absent exceptional circumstances a dentist,

physician, or podiatrist should not dispense a prescription drug
other than a starter dosage; now, therefore,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section(s) 12-102(c) of Article - Health
Occupations of the Annotated Code of Maryland be renumbered to be
Section(s) 12-102(d) 12-102(g).

SECTION 2. AND BE IT FURTHER ENACTED, That the Laws of
Maryland read as follows:

Article - Health Occupations

4-205.

(a) In addition to the powers set forth elsewhere in this
title, the Board may:

(1)   [adopt] ADOPT rules and regulations governing:

[(1)] (I) The administration of general anesthesia by
a licensed dentist;

[(2)] (II) The administration of parenteral sedation
by a licensed dentist; and

[(3)] (III) The use of a dental assistant by a
licensed dentist in performing intraoral procedures; AND

(2)  AFTER CONSULTING WITH THE STATE BOARD OF
PHARMACY, ADOPT RULES AND REGULATIONS REGARDING THE DISPENSING OF
PRESCRIPTION DRUGS BY A LICENSED DENTIST-; AND

(3) ON RECEIPT OF A WRITTEN AND SIGNED COMPLAINT,
INVESTIGATE AN ALLEGED VIOLATION OF THIS TITLE
.
