(a)(2) The Secretary may not issue a permit under this
subsection until complete plans and specifications for the
installation, alteration, or extension, together with any other
information the Secretary may require, have been submitted and
approved by the Secretary. All construction shall take place in
accordance with the approved plans. If it becomes necessary or
desirable to make material changes in plans or specifications,
the changed plans or specifications, together with a statement of
the reasons for the alterations, shall be submitted to the
Secretary, and no material changes may be embodied in the actual
construction until they are approved by the Secretary AFTER A
PUBLIC HEARING, and a permit issued for them. After completion
of the work a certified copy of the plans in full, showing the
work as built, shall be filed with the Secretary for permanent
record.

(e) (1) A permit to operate a landfill refuse disposal
system or sludge composting facility shall be valid for a period
of 3 years from the date of issue, unless suspended or revoked by
the Department.

(2)  The permit shall be automatically renewed upon
written approval of the Department.

(3)  THE DEPARTMENT MAY REFUSE TO RENEW A PERMIT IF:

(I)  THE PERMITTEE HAS NOT COMPLIED WITH THIS
SUBTITLE, ANY RULES OR REGULATIONS ADOPTED UNDER THIS SUBTITLE,
OR ANY CONDITION OF THE PERMIT; OR

(II)  THE DEPARTMENT FINDS THAT CONTINUED
OPERATION OF THE SYSTEM OR FACILITY WOULD BE INJURIOUS TO THE
PUBLIC HEALTH OR TO THE ENVIRONMENT . ; OR

(III) THERE IS ANY OTHER GOOD CAUSE, AS
DETERMINED BY THE DEPARTMENT.

[(4) If the Department does not grant written
renewal approval prior to the permit's expiration [because of
failure to comply with the conditions of the permit], the
permittee shall comply with all provisions required by the
Department within the prescribed time period [ , or file a new
application]. ]

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1986.
