CHAPTER 663

AN ACT concerning

Commercial Casualty Joint Underwriting Association

FOR the purpose of creating the Commercial Casualty Joint
Underwriting Association to provide a mechanism for the
payment of certain indemnities to certain persons and for
enabling commercial entities to obtain insurance against

liability for certain injuries; providing that the

Association shall be activated under certain circumstances
for the function, structure, and duties of the Association;
providing that the Association be administered by a Board of
Governors and providing for the membership of the Board;
providing that the Insurance Commissioner has certain powers
and duties; providing for membership in the Association;
providing for the establishment of certain subpools;
providing for a certain program of operation and its for
certain plans of operation and for their applicability;
providing for the participation of insurers in the expenses,
profits, and losses of the Association; providing for a rate

stabilization reserve fund for each subpool certain

assessments and recoupments; providing that this Act does
not apply to certain types of insurance; providing that the
Association is not a department, unit, agency, or
instrumentality of the State and that the State is not
responsible for the debts, claims, obligations, and
liabilities of the Association; providing for the
termination of this Act; providing that the Association may
enter into certain contracts; providing for certain
procedures; defining certain terms; stating the purpose of
this Act; limiting the liability of certain persons for
actions taken or statements made in the implementation of
this Act; providing that the Association need not provide
insurance under certain circumstances; and generally
relating to the creation of a Commercial Casualty Joint
Underwriting Association.

BY adding to

Article 48A - Insurance Code

Section 598 through 606 607 to be under the new subtitle

"Subtitle 43. Commercial Casualty Joint Underwriting

Association"
