the current program for the treatment of mentally retarded
individuals and nonretarded developmentally disabled
individuals; establishing a Developmental Disabilities
Administration; authorizing the establishment of a State
Plan for providing certain services to individuals with
developmental disability and to certain other disabled
individuals; providing for the implementation of the State
Plan; specifying the powers and duties of the Secretary;
authorizing the licensure, certification, and regulation of
certain providers of services; providing for an application
process to determine an individual's eligibility for certain
services; requiring an evaluation before an individual is
approved for services; providing for the Secretary to
consider certain factors in determining any allocation of
services to eligible individuals; providing for the appeal
of certain actions of the Secretary as to eligibility for
services or receipt of services; transferring the operation
of a family support service program from the Department of
Health and Mental Hygiene to the Administration; providing
for the use of local funds for certain nonresidential
programs; prohibiting persons from providing certain
services without a license; providing a penalty for
violation of certain license requirements; providing for the
operation of State residential centers for individuals with
mental retardation; providing standards for admission to and
release from State residential centers; providing for
hearings on admission to State residential centers;
providing for the operation of community based programs in
public and private group homes and in alternative living
units; providing for the transfer of certain individuals
between programs and facilities; stating the fundamental
rights of certain individuals while receiving certain
services, including services received as a resident in a
State residential center; providing for the disclosure of
records of certain individuals under certain conditions;
requiring a plan of habilitation for individuals receiving
certain services; providing for the continuation of certain
services to individuals who were eligible and receiving the
services in a program or facility of the Mental Retardation
and Developmental Disabilities Administration; continuing
the existence of a citizens' advisory board for certain
State residential centers; providing for an opportunity for
a hearing in a proposed transfer from the Mental Hygiene
Administration to the Developmental Disabilities
Administration; providing for certain changes in
nomenclature and terminology; deleting as obsolete the
reference to certain day care centers under this
jurisdiction of the Mental Retardation and Developmental
Disabilities Administration; and generally relating to the
administration by the State of services to individuals with
developmental disability and to certain other disabled
individuals.
