SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article 25A - Chartered Counties of Maryland
5.
The following enumerated express powers are granted to and
conferred upon any county or counties which hereafter form a
charter under the provisions of Article XI-A of the Constitution,
that is to say:
(X)
(1) (i) To enact local laws, for the protection and
promotion of public safety, health, morals, and welfare, relating
to zoning and planning, including:
1. [the] THE power to provide for the right of
appeal of any matter arising under such planning and zoning laws
to the circuit court, except as is provided in § 5(U) of this
article. Any decision of the circuit court may be appealed to the
Court of Special Appeals[.]; AND
2. THE POWER TO ESTABLISH A PROGRAM FOR THE
TRANSFER OF DEVELOPMENT RIGHTS.
(ii) To provide by ordinance that a violation of a
zoning law or regulation enacted under this section may be a
civil zoning violation. The violation shall be enforced as
provided in Article 66B, § 7.01(c) of the Code.

(b) (1) Each district council, respectively, in accordance
with the conditions and procedures specified in this article, may
by ordinance adopt and amend the text of the zoning ordinance and
may by resolution or ordinance adopt and amend the map or maps
accompanying the zoning ordinance text to regulate, in the
portion of the regional district lying within its county, [(1)]
(I) the location, height, bulk, and size of buildings, other
structures, and units therein, building lines, minimum frontages,
depths and areas of lots, and percentages of lots which may be
occupied; [(2)] (II) the size of lots, yards, courts, and other
open spaces; [(3)] (III) the erection of temporary stands and
structures; [(4)] (IV) the density and distribution of
population; [(5)] (V) the location and uses of buildings and
structures and units therein for trade, industry, residence,
recreation, agriculture, public activities, and other purposes;
and [(6)] (VI) the uses of land, including surface, subsurface,
and air rights therein, for building, trade, industry, residence,
recreation, agriculture, forestry, or other purposes.
