Article 28 - Maryland-National Capital Park and Planning
Commission
Section 2-118(a)(5) and 7-108(d)(l)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

(a) (5) Each county council, upon approval of the budget,
shall deliver it within three calendar days to the respective
county executive who, within ten days thereafter, may disapprove
or reduce any item contained in it. If the county executive
disapproves, reduces or modifies any item in the budget, he shall
return it to the respective county council with the reasons for
his disapproval or reduction stated in writing. Budget item
refers to items within the funds described herein or the planning
work program. The Montgomery County Council may, by affirmative
vote of [four] 5 of its members, and the Prince George's County
Council may, by affirmative vote of a majority of its members,
reapprove or restore any item over the disapproval of the
respective county executive within 30 calendar days.

(d) (1) Initiation. The Commission may initiate any plan or
part thereof with the concurrence of the district council of the
county or counties in which the area of the proposed plan is
located, provided that review of the Commission's proposed budget
by the district council and approval of the planning schedule
which shall be contained therein shall constitute concurrence in
the initiation of plans proposed in the budget for any single
fiscal year. The district council may modify or change the
schedule contained in the proposed budget. IN MONTGOMERY COUNTY,
ANY MODIFICATION OR CHANGE SHALL BE DONE ONLY WITH THE APPROVAL
OF THE COUNTY EXECUTIVE. IN THE EVENT OF EXECUTIVE VETO, THE
COUNCIL MAY OVERRIDE THE VETO BY AN AFFIRMATIVE VOTE OF 5
MEMBERS. Further, the district council may direct the Commission
to initiate any plan or part thereof, and the Commission shall
initiate the plan with reasonable promptness to the extent funds
are available for this purpose.
