(II)  FOR GOOD CAUSE THE DEPARTMENT MAY ACCEPT
AN APPLICATION FROM A HOMEOWNER AFTER SEPTEMBER 1 BUT ON OR
BEFORE APRIL 15 OF THE TAXABLE YEAR IF THE HOMEOWNER:

1.  IS AT LEAST 70 YEARS OLD; AND

2.  RECEIVED A CREDIT UNDER THIS SECTION
FOR THE PREVIOUS TAXABLE YEAR.

(III)  The Department shall notify the homeowner
in writing of its acceptance or rejection of a late application.

(3)  The homeowner shall state under oath that the
facts in the application are true.

(4)  To substantiate the application, the applicant

may be required to provide a copy of an income tax return, or
other evidence detailing gross income or net worth.

SECTION 2. AND BE IT FURTHER ENACTED, That only for the

taxable year 1985/1986, if the Department receives an application
on or before June 1, 1986, the Department may accept the
application under the conditions of this Act.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall

take effect July 1, 1986.

(House Bill 1081)

AN ACT concerning

Striped Bass - Hybrids - Freshwater Impoundments

FOR the purpose of declaring a hybrid of the species of fish

known as striped bass or rockfish not to be a threatened or
endangered species for certain purposes; requiring the
Department of Natural Resources to adopt regulations as part
of any regulations under the Endangered Species of Fish
Conservation Act pertaining to striped bass; providing that
certain regulations shall permit the catching of hybrids of

striped bass in certain freshwater impoundments under
certain circumstances
; authorizing a person to catch,
possess, and transport Hybrids of striped bass or rockfish
caught in certain freshwater impoundments; eliminating
certain prohibitions of law against the taking, possessing,
or transporting of hybrids of striped bass or rockfish;
