(4)  THE SECRETARY MAY TRANSFER LEAVE DAYS FROM THE
FUND TO ANY EMPLOYEE WHO:

(I)  HAS A DOCUMENTED MEDICAL DISABILITY; AND

(II)  HAS EXHAUSTED ALL APPROPRIATE LEAVE WITH
PAY BENEFITS . ; AND

(III)  HAS COMPLETED AT LEAST 1 YEAR OF STATE
SERVICE.

(5)  THE SECRETARY SHALL DETERMINE AN EMPLOYEE'S
ELIGIBILITY TO WITHDRAW LEAVE FROM THE FUND BASED, IN PART, ON:

(I)  DOCUMENTATION INDICATING THAT THE EMPLOYEE
HAS A LONG-TERM ILLNESS AND IS UNABLE TO WORK; AND

(II)  A RECOMMENDATION RECEIVED FROM THE STATE
MEDICAL DIRECTOR.

(6)  THE SECRETARY SHALL PRESCRIBE THE LENGTH OF TIME
FOR WHICH AN EMPLOYEE MAY RECEIVE LEAVE DAYS FROM THE FUND.

(7)  THE SECRETARY MAY NOT TRANSFER ANY LEAVE UNDER
THIS SUBSECTION TO A STATE EMPLOYEE WHO HAS BEEN GRANTED
DISABILITY RETIREMENT BY THE BOARD OF TRUSTEES OF THE STATE
RETIREMENT SYSTEMS FOR USE AFTER THE FIRST DATE ON WHICH
DISABILITY RETIREMENT MAY BECOME EFFECTIVE.

[(b)] (C) Whenever any classified employee is dismissed
from the classified service for any cause involving moral
turpitude, the employee shall forfeit all unused vacation time
and compensation for all unused vacation leave. Whenever the
service of any classified employee is terminated within six
months from the date of his original appointment to the
classified service, the employee is not entitled to any vacation
leave or compensation for vacation leave. Subject to the
exceptions of this subsection and excluding employees covered
under collective bargaining agreements, every classified
employee, unclassified employee, or appointed official, upon the
termination of his State service, shall be entitled to receive a
sum equivalent to one tenth of his established biweekly amount of
compensation at the time his employment terminates, multiplied by
the number of days of his earned and unused annual leave which
was accumulated as of the end of the last calendar year preceding
termination (subject to a maximum accumulation of 35 working
days) and the number of days of annual leave and no more than two
days compensatory leave earned and unused during the calendar
year in which employment is terminated.

[(c) (1) In addition to the sick leave and other leave that
otherwise is authorized under this section, the Secretary of
Personnel may by rule provide for granting extended periods of
sick leave with sick pay or with part sick pay to employees who
