Article - Natural Resources
10-601.

(a)  In this subtitle the following words have the meanings
indicated.

(b)  "Blind site" means  a specific location in the water
where a person may hunt    wild waterfowl from any boat or raft
which is tied to or anchored  at a stake and is not a permanent
structure.

(h) "Stationary blind" means a permanent offshore structure
built on piling or stakes and used for hunting wild waterfowl.

IN EACH COUNTY OF THE STATE WHERE WILD WATERFOWL ARE

ADEQUATE AND HUNTING IS ALLOWED UNDER THIS SUBTITLE, TO PROVIDE
GREATER PUBLIC ACCESS AND USE OF STATIONARY BLINDS AND BLIND
SITES IN ON PUBLIC LANDS THAT BORDER PUBLIC WATERS OR PONDS AND
IN THE PUBLIC WATERS OF THE STATE THAT ARE ADJACENT TO PUBLIC
LANDS, THE DEPARTMENT SHALL:

(1)  CONSTRUCT AND MAINTAIN LOCATE AND DESIGNATE
STATIONARY BLINDS AND BLIND SITES IN ON PUBLIC LANDS THAT BORDER
PUBLIC WATERS OR PONDS AND IN THE PUBLIC WATERS OF EACH COUNTY OF
THE STATE WHERE HUNTING WILD WATERFOWL IS ADEQUATE AND ALLOWED
UNDER THIS SUBTITLE; AND

(2)  PROVIDE FOR USE BY THE PUBLIC OF THE STATIONARY
BLINDS AND BLIND SITES ON A LOTTERY BASIS, IF NEEDED.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall

be construed only prospectively and may not be applied or
interpreted to have any effect upon or application to any
stationary blind or blind site that was constructed and
maintained for the use of the public before the effective date of
this Act.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1986.
