CHAPTER 410

(House Bill 48)

AN ACT concerning

FOR

Motor Vehicles - Right Turn on Red

the purpose of clarifying that a vehicle making a right turn
at a steady red signal shall yield the right-of-way to a
vehicle approaching the intersection in a certain manner.

BY repealing and reenacting, with amendments,

Section 21-202(d)
Annotated Code of Maryland
(1984 Replacement Volume and

1985 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF

MARYLAND, That the Laws of Maryland read as follows:

21-202.

Article - Transportation

(d) (1) Vehicular traffic facing a steady red signal alone:

intersection:

(i) Shall stop at the near side of the

1. At a clearly marked stop line;

2. If there is no
line, before entering any crosswalk; or

clearly marked stop

3. If there is no crosswalk, before
entering the intersection; and

(ii) Except as provided in paragraph (2) of
this subsection, shall remain stopped until a signal to proceed
is shown.

(2) Unless a sign prohibiting a turn is in place,
vehicular traffic facing a steady red signal, after stopping as
required by paragraph (1) of this subsection, cautiously may
enter the intersection and make a right turn. If a sign
permitting any other turn is in place, vehicular traffic facing a
steady red signal, after stopping as required by paragraph (1) of
this subsection, cautiously may enter the intersection and make
the turn indicated by the sign. In each instance, this vehicular
traffic shall yield the right-of-way to any pedestrian lawfully
within an adjacent crosswalk and to any [other traffic lawfully

using the intersection] VEHICLE IN THE INTERSECTION OR
