[(d)](E) Nothing in this section shall be construed to
prevent the carrying of any of the weapons mentioned in
subsection (a) of this section by an officer of this State, or of
any county or city therein, who is entitled or required to carry
such weapon as part of his official equipment, or by any
conservator of the peace, who is entitled or required to carry
such weapon as part of his official equipment, or by any officer
or conservator of the peace of some other state temporarily
sojourning in this State, or by any special agent of a railway or
by any person to whom a permit to carry a concealed weapon has
been issued under § 36E of this article, or by any person who
shall carry such weapon as a reasonable precaution against
apprehended danger, but the tribunal before which any case
arising under the provisions of this section may be tried, shall
have the right to judge of the reasonableness of the carrying of
any such weapon, and the proper occasion therefore, under the
evidence in the case.
339.
(A) It shall be unlawful for any person, firm or
corporation or the agent of either, whether a licensed dealer or
not, to sell, barter, display or offer to sell or barter[,]:
(1) ANY [any] knife having a blade which opens
automatically by hand pressure applied to a button, spring or
other device in the handle thereof, commonly called "switchblade"
knives, or any switchblade penknife operating in a similar
manner? OR
(2) A DEVICE, COMMONLY KNOWN AS A "SHOOTING KNIFE",
THAT IS DESIGNED TO PROPEL A KNIFE FROM A METAL SHEATH BY MEANS
OF A HIGH-COMPRESSION EJECTOR SPRING,
(B) Any person or any agent, violating this section, shall,
on conviction thereof, be fined not less than fifty nor more than
five hundred dollars and/or imprisoned for not more than 12
months.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1986.
