SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article 40A - Maryland Public Ethics Law
2-105.
(d) If the complaint concerns any other person, the
Commission promptly shall refer the complaint to its staff
counsel for further action. With respect to such complaints.
(8) (I) If the Commission decides that the respondent
has violated any of the provisions of this article, the
Commission may:
1. issue an order of compliance to cease
and desist from the violation[, may];
2. issue a reprimand[, or may];
3. recommend to the appropriate
authority, if provided by law, for the censure, the removal, or
other appropriate disciplining of the respondent; OR
4. IMPOSE A CIVIL PENALTY NOT TO EXCEED
$5,000 IF THE COMMISSION DETERMINES THAT THE RESPONDENT HAS
VIOLATED ANY PROVISION OF THIS ARTICLE.
(II) IN ASSESSING ANY CIVIL PENALTY UNDER THIS
PARAGRAPH, THE COMMISSION SHALL CONSIDER:
