Ch. 5

Finance and Procurement Article in Ch. 11 of the Acts
of the Regular Session of the General Assembly of
1985. The stylistic errors occurred in Ch. 538 of the
Acts of the Regular Session of the General Assembly of
1985.

The outdated cross-references were noted by the State
Attorney General in his bill review letter of May 16,
1985. The stylistic errors were noted by the Michie
Company.

Article - Transportation

3-216.

(d) (2) Expenditures under this subsection shall be made in
accordance with any appropriation provided for in any applicable
budget bill or supplementary appropriation bill. However, an
appropriation proposed to be made to any unit in the Department
or proposed to be made for any designated transportation
activity, function, or undertaking that has been reduced by the
General Assembly may not be restored, for the same purpose as
originally proposed, except in an emergency, by the budget
amendment procedure of § 7-209 of the State Finance and
Procurement Article, or otherwise if the General Assembly in
striking or reducing the appropriation, prohibited its
restoration. However, except for emergency capital projects, if
the General Assembly explicitly reduces in the budget bill an
appropriation proposed for a major capital project as defined in
[§ 2-103.1(a)(3)] § 2-103.1(A)(4) of the Transportation Article,
the appropriation may not be restored for the same purpose as
originally proposed by the budget amendment procedure of § 7-209
of the State Finance and Procurement Article or otherwise unless
the General Assembly, in striking or reducing the appropriation,
expressly authorized its restoration.

DRAFTER'S NOTE: This corrects an outdated cross-reference
in § 3-216(d)(2) of the Transportation Article.

TR § 2-103.1(a)(3) became TR § 2-103.1(a)(4) in Ch. 11
of the Acts of the Regular Session of the General
Assembly of 1985.

The outdated cross-reference was noted by the Michie
Company.

5-212.

(d) An airport police employee is not a police employee as
defined in Article 88B, § 2 of this Code unless he qualifies as
such. However, all other provisions of Article 88B, except [§§
4(a) through 4(d)] § 4(A) THROUGH (D), are applicable to an
airport police employee to the same extent they are applicable to
a police employee of the Maryland State Police, unless
specifically provided otherwise.
