Subtitle 3. [Certification] LICENSING.
DRAFTER'S NOTE: This corrects an outdated Subtitle 3. in
Title 5.5 of the Health Occupations Article.
Ch. 219 of the Acts of the Regular Session of the
General Assembly of 1985 substituted licensure for the
certification requirements for environmental
sanitarians in Title 5.5, Subtitle 3 of the Health
Occupations Article.
The outdated subtitle was noted by the Michie Company.
Article - Natural Resources
3-102.
(b) This subtitle shall be liberally construed to effect
its purposes. However, nothing contained in it shall restrict any
control which the Departments of Health and Mental Hygiene and
Natural Resources, or of their units, are empowered to exercise
over any water supply, wastewater purification or solid waste
disposal project authorized by this subtitle, except as provided
in [§ 3-113(e)] § 3-103(I) OF THIS SUBTITLE; nor interfere with
or affect the operation of existing wastewater purification,
water supply, or solid waste disposal projects found by the
Secretary of Health and Mental Hygiene to be adequately and
lawfully operated by municipalities having jurisdiction or
responsibility for them, except by their express consent and
agreement.
DRAFTER'S NOTE: This corrects an erroneous cross-reference
and a stylistic error in § 3-102(b) of the Natural
Resources Article.
The erroneous cross-reference and stylistic error were
contained in Ch. 4 of the First Special Session of the
General Assembly of 1974.
The erroneous cross-reference was noted by the
Maryland Environmental Service. The stylistic error
was noted by the professional staff of the Legislative
Division of the Department of Legislative Reference.

(b) Any money of the Service, in its discretion and unless
otherwise provided in any agreement or covenant between the
Service and the holders of any of its obligations limiting or
restricting classes of investments, may be invested in bonds or
other obligations of, or guaranteed as to principal and interest
