(c) The Maryland AIDS Research and Information Fund is a
continuing, nonlapsing, revolving Fund, and any unexpended moneys
remaining in the Fund at the end of a fiscal year may not revert
to the General Fund of the State.
(d) The Maryland AIDS Research and Information Fund Tax is
imposed for 1 year from the effective date of this Act on
cigarettes and shall be at the rate of 0.5 cents for each 10
cigarettes or fractional part thereof when such cigarettes are in
packs containing 20 or fewer cigarettes each. On packs of
cigarettes containing more than 20 cigarettes each, the first 20
cigarettes in each pack shall be taxed at the rate of 0.5 cents
for each 10 cigarettes, and the tax shall be 0.5 mills per
cigarette on each cigarette in excess of 20 contained in each
pack. After the 1 year from the effective date of this Act, the
tax imposed by this Act shall be of no further force or effect.
(e) The Comptroller shall pay the proceeds from the
Maryland AIDS Research and Information Fund Tax into the Maryland
AIDS Research and Information Fund. The proceeds received from
the tax may only be dispersed into the Fund.
(f) The tax imposed by this Act shall be in addition to,
and not in place of, any other tax that is or may be imposed on
cigarettes in the State.
(g) The provisions of Article 81, §§ 431 through 464 of the
Code not consistent with this Act shall be applicable to the tax
imposed by this Act.
FOR the purpose of requiring the Secretary of Health and Mental
Hygiene to provide certain information and support services
on Acquired Immune Deficiency Syndrome (AIDS) establish
certain programs regarding Acquired Immune Deficiency
Syndrome (AIDS); and generally relating to the establishment
of the Acquired Immune Deficiency Syndrome (AIDS) Program.
