LAWS OF MARYLAND

Ch. 263

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 27 - Crimes and Punishments

698A.

(A)(1) EXCEPT AS OTHERWISE PROVIDED IN THIS SECTION,
WHENEVER AN INMATE IN ANY INSTITUTION UNDER THE CONTROL OF THE
DIVISION OF CORRECTION DIES WHILE IN CUSTODY, THE EXPENSES OF THE
BURIAL AND FUNERAL OF THE INMATE SHALL BE PAID BY THE STATE.

(2) THE STATE IS NOT REQUIRED TO PAY THE EXPENSES OF
THE BURIAL AND FUNERAL OF AN INMATE WHO DIES WHILE IN CUSTODY OF
THE INMATE HAS INSURANCE THAT PAYS THE EXPENSES OF THE BURIAL AND
FUNERAL OF THE INMATE.

(B) THE COMMISSIONER OF CORRECTION SHALL ADOPT REASONABLE
RULES AND REGULATIONS THAT SET FORTH PROCEDURES FOR CARRYING OUT

THE PROVISIONS OF THIS SECTION.

(A) (1) EXCEPT AS OTHERWISE PROVIDED IN THIS SECTION,
WHENEVER AN INDIGENT INMATE IN ANY INSTITUTION UNDER THE CONTROL
OF THE DIVISION OF CORRECTION OR PATUXENT INSTITUTION DIES WHILE
IN CUSTODY, THE EXPENSES OF THE FUNERAL AND BURIAL OF THE
INDIGENT INMATE SHALL BE PAID BY THE STATE.

(2) THE EXPENSES OF THE FUNERAL AND BURIAL ARE THE
SAME AS THOSE PROVIDED BY THE DEPARTMENT OF HUMAN RESOURCES UNDER
ARTICLE 88A, § 62A OF THE CODE, EXCEPT THAT THERE IS NO CHARGE
AGAINST LOCAL FUNDS.

(3) THE FAMILY OF AN INDIGENT INMATE MUST BE KNOWN OR
REGISTERED WITH THE DEPARTMENT OF HUMAN RESOURCES IN ORDER TO
RECEIVE THIS BENEFIT.

(4) IF THE BODY OF AN INDIGENT INMATE IS NOT CLAIMED
WITHIN 48 HOURS, THE STATE ANATOMY BOARD WILL MAKE DISPOSITION IN
ACCORDANCE WITH § 5-406 OF THE HEALTH - GENERAL ARTICLE.

(B) THE COMMISSIONER OF CORRECTION AND THE DIRECTOR OF
PATUXENT INSTITUTION SHALL ADOPT REASONABLE RULES AND REGULATIONS
THAT SET FORTH PROCEDURES FOR CARRYING OUT THE PROVISIONS OF THIS
SECTION.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1986.
