   ready twelve as by his precept it was Commanded who being called
   came viz Samuel Thomas Ebenezr Blackiston Roger Hailes John Evans
   Daniel Farrolo Francis Bellows Chr Bellican Robert Green Edward
   Davis Samuel Norris Benj.n Blackleage Zachariah MacDaniel which
   Jury being duely Elected tryd & Sworn And the Plt having Proved
   his Accot. and the Jury having heard the pleadings and allegations
   on both Sides The Deft. proves his Accot. also The Jury gives in their
   verdict at the bar vizt The Jury being Called over do appear the Plt~
   also apprs the afd Deft denys to appr.- And the afd Jury Say that
   as to ye first assumption above mentioned the afd Deft~ discount of
   three Thousand four hundred twenty three pds of Tobo. ought Not to
   have but as to the Second assumption they find ye Deft~ did not
   assume in manner and forme as above declared as to the third —
   assumption he did assume in manner & forme as above declared
   & find Damages the Sume of Seven hundred Eighty two pounds .
   of Tobacco and one half pound of Tobacco Damages one hundred and Eight—
   pounds of Tobacco with Cost And by Samuel Thomas there—
   foreman all So Say The Plt~ by his afde attry prays Judgment-
   on the verdict afd —— Therefore it is Considered by the
   Court here vizt. this twenty fourth day of Novemb.r Anno Domi.
   one Thousand Seven hundred and Sixteen That the afd Plt~
   John Faning Recover against the Said Deft~ John Moore as
   well the afd Sume of Seven hundred Eighty two pounds of~
   Tobacco and one half pound of Tobo and one hundred and .
   Eight pounds of Tobacco in the whole amounting to the Sume
   of Eight hundred and ninety pounds of Tobacco and one half
   pound of Tobo. Damages by the Jury afd assessed as also the
   Sume of Six hundred forty four pounds of Tobacco Cost by the
   Plt afd Expended and by the Court here of his assent adjudged and
   the Said Deft in mercy &ca.
