     97                                   Novembr Cort 1716
   fourteen at the Parish afd in Kent County afd within the Jurisdiciõn of—
   this Court upon himselfe assumed and to the Said Plt~ then and there last
   Said faithfully Promised that he ye Same Deft the Sd one hundred & eight pounds
   of Tobacco to the Said Plt~ when thereunto required would well and truly
   pay and Content Nevertheless the afd Deft his Severall Promises and —
   assumptions afd as to the afd Severall Sumes of Tobacco in the whole
   amounting to the Sume of five Thousand nine hundred fifty and Eight
   pounds of Tobacco he hath not minded nor kept but althõ the Said
   Deft~ hath paid and Satisfied to the Said Plt~ Three Thousand two —
   hundred Sixty Seven pounds of Tobacco and one half pound of Tobo.

   Tobacco part Yet the Sume of Two Thousand Six hundred and ninety
   pounds of Tobacco and one half pound of Tobacco of the afd five
   Thousand nine hundred fifty & Eight pounds of Tobacco residue little
   regarding but fraudulently Intending the Said Plt~ in that behalfe
   to deceive and defraud the afd two Thousand Six hundred and ninety
   pounds of Tobacco and one half pound of Tobacco to the afd Plt
   altho afterwards viz the fourth day of March and often after Anno
   Domini Seventeen hundred and fourteen afd he was at St Pauls
   Parish at Kent County afd within the Jurisdiciõn of this Court thereto
   required hath not paid nor made Content for the same but the Same
   to pay or Content the Said Deft hitherto hath denied & yet denys —
   to the damage of the Said Plt~ five Thousand pounds of Tobacco
   and thereupon he brings Suite &ca T Bowne pr qr pls &ca John Doe & Rd
   Roe   ————   Dr John Moore March 3: 1713 To one years
   accomodating him & ye use of one Shop &ca. 1800.lb Tobo March 3: 1714 To his
   accomodations in meat drink washing & Lodging pr one year   2200lb Tobo   Ditto his
   Carpenters   50lb Tobo To his Levey paid for him   108.lb Tobo Totall 4158lb Tobo Contra
   Credit Received 1800lb Tobo   D.o for weaving 58½ yds Cloath at 5-265½
   By Mr Wilmer 48.lb Tobo By Majr William Potts 684lb Tobo By Mr Wm Frisby .
   470lb Tobo — 3267½    Balle due 809lb Tobo    Errors Excepted pr ordr.
   of Jno Faning ——
   And the afd Deft by James Earle his attry apprs. to ye above Accon
   and prays liberty thereof to imparle thereto and to answer at next
   Court which is granted the Same day is given the Plt also ——
    And the afd cause - being Continued from the Sixteenth day of August
   Anno Domini one Thousand Seven hundred and fifteen and -
   from that Court then held to the then next Cort and So from Court to Court
