Novbr. Court~ 1716 71 return of Said writ Came William Frisby Gent- high Sherf of Said County and made return thereof in these words thereon endorsed as folls vizt. Non Est Inventus pr Wm Ffrisby Sherf Likewise Commanded it was to the Sherf of Kent Coty the twentieth day of June Anno Domi 1716 as abovesd and the Sherf made return thereof on the twenty first day of August ye Same year last mentioned Non Est Inventus &ca. Likewise Commanded it was to the Sherf of Kent Coty the twenty first day of August ye Same year last mentioned and ye Sherf made return thereof on the Twentieth day of Novembr. ye Same year last mentioned Non Est Inventus And A Declaration being filed when the first writ Issued forth and a Copy thereof Sent therewith which folls vizt Kt Coty Ss Walter King of Kent County Tanner alis Dics Walter King of Kent County Tanner was Summoned to answer Thomas Bowne of a plea that he render him ye Sum of Sixteen hundred thirty & Six pounds of good Sound Merchantable leafe Tobacco in Caske of the value of thirteen pounds twelve Shillings and eight pence Sterling money which he unjustly detains &ca. and whereupon the afd Thomas in Proper person Saith that whereas the afd Walter the Eighteenth day of Aprill Anno Domini Seventeen hundred and fifteen at [St] Pauls. Parish in Kent County afd within the Jurisdiciõn of this Court by his Certain writing obligatory which the Said Walter Sealed with his Seale and as his deed delivered here into Court brought the date whereof is the Same day & Year afd Granted himselfe holden and firmly bounden to the afd Thomas in the afd Sum of Sixteen hundred thirty & Six pounds of good Sound Merchanble leafe Tobacco in Cask of ye^afdvalue of thirteen pounds twelve Shillings & Eight pence Sterling money to be paid to the afd Thomas when thereunto required Yet the afd Walter altho’ often required the afd Sixteen hundred Thirty & Six pounds of Tobacco to the Said Thomas hath not rendered or paid but the Same to render or pay the Said Walter hitherto hath denied and Yett doth deny and unjustly detain to the damage of the Said Thomas - Twenty pounds Sterling money and thereupon he brings Suite &ca TBowne in pr person pls &ca. Jno Doe & Rd Roe And now at this Court Came the afd Plt~ and Saith that there hath been three writs returnd Non Est Inventus agst. the Said Deft~ on which he prays that he may have Judgment for an Attachment~ agst. the goods and Chattells Rights and Credits of the afd Deft~ for the afd Sume of Sixteen hundred and thirty Six pounds of Tobacco : Therefore it is Considered by the Court here viz.t This Twenty Second day of- Nov : |
