   62                                      Novbr. Court 1716
   according to the Said Laws and Customes of our Said Province and the -
   forme of the Statutes and Acts of Assembly thereof had & used or to be
   had and used Butt we will not that you proceed in any the Cases afd to take
   life or membr. but that in every Such Case you Send the Prisoners with
   their Indictments and the whole matter depending before you to our
   Justices of our next Provinciall Court to be held for this our Province be it
   whensoever or wheresoever to be holden thereto be tryd And we Command
   you and every you Deligently to Intend the keeping the peace ordinances
   & Statutes and all and every the premises and that at your County Courts -
   you make Inquisition and hear and Determine as afd doing therein—
   what to Justice appertains according to the Laws and Customes afd And —
   further we do Constitute ordaine and appoint you the Said Nathaniel
   Hynson Edward Scott W.m Comegys Michl. Miller Lambert Wilmer —
   Henry Lowe Junr. John March Saml. Wickes and Marmaduke Tilden—
   or any three or more of you as afd to Issue out writs precepts Process —
   and Attachments and hold plea of Oyer and Terminer of all accõns —
   popular & upon the Statute and of all Accõns prsonall of whatsort Soever
   wherein the Demand doth not Exceed the Sume of one hundred pounds -
   Sterlg or thirty Thousand pounds of Tobacco and all accõns prsonall now
   Depending before you be the demand of how great Soever and after .
   Judgment Executions to award in all Such Causes and Accõns as afd according
   to the afd Laws orders & Customes of the Kingdome of Great Brittaine
   called England and this our Province in which Said Accõns so to be
   tryd we do Constitute ordaine and appoint You the Said Nathaniel
   Hynson Edward Scott William Comegys Michael Miller Lambert Wilmer
   Henry Lowe Junior John March Samuel Wickes and Marmaduke Tilden
   and none others to be Judges also by these presents wee do Command the
   Sherf of our Said County of Kent that at the Severall Courts to be held
   for Said County he give his attendance and cause to come before you or
   any three or more or you as afd such and So many good and Lawfull —
   men of his Baylewick out of each and every hundred thereof by whome
   the truth of the matter in the premises may be the better known~
   & enquired of Lastly you Shall cause to be brought before you at your
   Said Courts all writs precepts process and Indictments to your Courts and —
   Jurisdicion- belonging that the Same may be Inspected and by
   due Course of Law be determined witness our trusty and well—
   beloved John Hart Esqr. our Capt. General and Governour in chiefe—
   in and over this our Province of Maryland and the Territories -
