   325                                  March Court 1717
   tenth of November next Ensuing the date of the Said Bill obligatory Yet
   the afd Deft altho’ often required the afd Quantity of one Thousand
   pounds of Tobacco to the afd Plt. hath not paud or cause to be paud but
   that to him to render or pay hath hitherto denied & Still doth denie
   and unjustly detaine to ye damage of him the Said Plt. Twelve pounds
   Sterling & Thereupon he brings Sute &ca. TBowne pr Querr pls Jno Doe & Rd Roe.
   and the Said Deft~ being Called came and the afd Deft in his proper
   person appeared to the afd Accõn and Saith that he Cannot gainsay the
   Accõn afd of him the Said Plt nor but that the bill obligatory afd—
   mentioned in his Act and deed and that he oweth unto the afd Plt~
   the afd Sume of one Thousand pounds of Tobacco and is willing that
   Judgment Should be entered for the Same & Cost thereon Accruing —
   Therefore it is Considered by the Court here vizt. this Twentieth
   day of March Annoqe Domini One Thousand Seven hundred
   and Seventeen That the afd Plt Charles Smith Do recover against
   the Said Deft~ John Maning as well the afd Sume of one Thousand
   pounds of Tobacco Debt as also the Sume of Two hundred And
   Sixty pounds of Tobacco Cost by the afd Plt about his Sute in this
   behalfe Expended and by the Court here of his assent adjudged and
   the Said Deft~ in mercy &ca

   William Frisby | Commanded it was to the Sherf of Kent County
            at | the Twenty third day of November in the Second
   John Mading - | Year of his Lordships Dominion &ca. That he

take John Mading of Kent County Planter if he
   Should be found in his Bailywick and him safe keep So that he have his
   body before his Said Lordships Justices of the next Court to be held at our
   Court house in the Town of Chester in Said County to Answer unto William
   Frisby late Sherife of Said County of a plea of Trespass of the Case and that
   he have then and there the Said writ &ca. Att. which Said next Court vizt.
   the Eighteenth day of March the Same year last mentioned the day of—
   return of Said writ came Simon Wilmer Gent. high Sherf of Said County &
   made return thereof in these words thereon Endorsed as folls vizt. Cepi Corpus .
   pr SWilmer Sherf.    And A Decln being fild when Said writ Issued forth and
   a Copy thereof Served therewith According to Act of Assembly in Such Case
   made was as folls vizt Kent County Ss John Mading of Kent County Planter Stands
