   257                                 November Court 1717
   that whereas the afd Deft the Eleventh day of November in the Year
   of our Lord Christ one Thousand Seven hundred and Sixteen at St—
   Pauls Parish in Kent County afd within the Jurisdicion of this Court by
   his certain bill obligatory which he the Said Deft~ Sealed with his
   Seale and as his deed delivered hereinto Court brought the date whereof
   is the Same day and Year afd bound himselfe his heires Executors &
   Administrators to pay or cause to be paid to the afd Plt the afd
   full and Just Sume of five hundred pounds of Tobacco of the afd
   Price and value of four pounds Sterling money Convenient upon
   Chester River in the afd County at or upon the tenth day of —
   November next Ensueing the date of the afd bill obligatory Yett the
   afd Deft altho often required the afd Sume of five hundred pounds
   of Tobacco to the Said Plt. hath not paid but that to him to
   render or pay or cause to be paid the Said Deft~ hitherto hath
   denied and Yett doth deny and unjustly detain to the damage of.
   the Said Plt. Six pounds Sterling money and thereupon he brings
   Suite &ca.

   And now at the Said Court came the Said Plt by his attry afd and
   the Said Deft being called came and the Said Plt by his afd
   attry prayd that the Said Deft~ may give Special baile to the
   afd Accõn which is granted and that he be kept in Safe Custody by
   the Sherf of Said County untill he Shall give Special baile as
   afd.
   After which John Twegue and Andrew Price both of Said County
   here in Court came and they and either of them doth Acknowledge
   themselves as Special baile in the afd Accõn and they and Each—
   of them^doundertake the Payment of the debt afd and Cost Accrueing
   if in case the afd Plt Shall obtaine Judgment against against~
   the Said Deft in the Said Accõn of Debt and the Deft the Condemna:
  :tion afd Should not Satisfie nor himselfe to the Custody of the
   Sherf of Said County deliver or that the afd John Twegue and Andrew
   Price or either of them the body of the afd Deft Shall not render &ca.
   And the afd Deft came into Court and in his proper person appeared
   to the afd Accõn . And Saith that he Cannot gainsay the Accon afd of
   him the Said Plt nor but that the bill afd is his Act and deed and .
   that he oweth unto the afd Plt the afd Sume of five hundred pounds
