   the Said Deft hitherto hath denyed & yett denies to the damage of y^e
   Said Plt twelve pounds Currant money of America and thereupon he
   brings Sute &c^a.

    And the afd Plt by his att^ry afd Prayd that the afd Deft to his Declⁿ.
   afd may answer . . This Court gives rule to the afd Deft to file a—
   plea to the afd Accõn four hours before this Court adjourns after .
   which no plea being put in by the Said Deft~ whereby the afd Plt
   may Still remain against the Said Deft without defence Therefore
   it is Considered by the Court here viz^t. this twentieth day of June
   Anno Domini One Thousand Seven hundred and Seventeen—
   That the afd Plt Hugh Durborow Recover against the Said
   Deft Thomas Hues as well the afd Sume of Three pounds
   nine Shillings and Six pence Damages by the afd Plt on
   Account of the Said Deft his not performing his promise and
   assumption afd as also the Sume of Three hundred and nine
   pounds of Tobacco Cost by the afd Plt about his Suite in this
   behalf Expended and by the Court here of his assent adjudged and
   that the Said Deft~ be taken into Custody &c^a —
