    191                                March Court 1716
   Parish in Kent County afd within the Jurisdiciõn afd was Indebted. unto
   the afd Daniel in the Sum of Seven hundred pounds of Merchantable
   Tobacco by him the Same Daniel at the like Special Instance & request
   and for ye proper use of the Said William then & there last Said laid -
   out and Expended and So being Indebted the Said William In Consideration
   thereof afterwards vizt. the day and year last Said in the County & Jurisdiciõn
   & parish last mentioned faithfully promised that he the Said William the
   afd last mentioned Seven hundred pounds of Tobacco to the Said Daniel
   when thereunto required would well & truly pay & Content Yet the afd William
   his Severall promises & assumptions afd Little regarding but fraudulently
   Intending the Said Daniel in that behalfe to deceive and defraud the afd
   Severall Sums of Tobacco in ye whole amounting to fourteen hundred
   pounds of Tobacco to the Said Daniel altho’ afterwards vizt the third day
   of June Anno Domini Seventeen hundred & fifteen and often after
   he was at ye Parish afd in the County and Jurisdiciõn afd thereto required
   hath not paid nor for the Same made any Content but that to pay or
   Content the Said William hitherto hath denied and Yet doth deny to ye.
   Damage of the Said Daniel Two Thousand pounds of Merchantable Tobacco
   and thereupon he brings Sute &ca- TBowne pr Querr pledgs &ca    Jno& Doe

    And the afd Plt by his attrney afd prays that the afd Deft to his Decln.
   afd may Answer
                                    And the afd Deft by John Johnson his attry comes &
   defends the force & injury when &ca. And Saith that the afd Plt his Accõn~
   afd against him the Said Deft to have or maintain ought not because
   by Proestation not acknowledging any Thing in the Decln afd to be —
   true but for plea the Said Deft~ Saith that after the assumpiõn & .
   promise afd Supposed to be made & before the afd Plt brought his Accõn
   afd against the Said Deft viz the first day of July in the year of our Lord
   one Thousand Seven hundred & Sixteen at the Parish of St. Pauls in the -
   County afd & within the Jurisdiciõn of this Court the Said Deft~ & the Said Plt
   came to Some discourse concerning the Said Sum of Seven hundred pounds
   of Tobacco in the Plts above Decln menconed to be due to the Said Plt~ a[s]
   afd to the Said Plt did then & there in consideration that the Said Deft
   did then & there upon himselfe assume to build a certain Tobacco house
   for the Said Plts use and at his the Said Plts request the Said Plt did
   then and there promise to the Said Deft~ that he the Said Plt would
   release & acquit the Said Deft of & from the payment of the Said Seven
   hundred pounds of Tobacco In the Said Plt above declaration menti:
  :oned and this he is ready to verefie wherefore prays Judgment if the
   Said Plt. his Accõn against him the Said Deft~ to have ought &ca.
