189 March Court 1716 be Inquired of by ye Country TBowne pr Querr And the Deft in like manner &ca. J Johnson pr Deft Command was therefore given to the Sherf of Kent County that~ he cause to come here twelve &ca. by whome &ca. To Recognize &ca. who neither &ca. Because as well &ca. And the Sherf of Said County comes & Saith that he hath here ready twelve &ca. as by his precept it was Commanded who being called Came viz.t John Hall William Graves Robert Green Daniel Colley Richard Fillingham John Cole Charles Ringgold Vincent Hatcheson Richard Scaggs John Clarke Charles . Smith Thomas Boots - who being duely Elected tryd & Sworn (and . the afd Plt by his attry afd prays the opinion of the Court whether - heare Say Shall be Received as Evidence The Court is of opion that~ the Evidences may be Sworn and the Jury may adjudged as they think fitt ) And the Jury having heard the Pleadings Evidences and allega: :tions on both Sides do withdraw to Consider and after Some time do againe return to the barr and being called over as also the Plt & Deft and being asked whether they were agreed on a verdict or not do Say they are and being demanded whether they find for the Plt or for William Glanvill Special baile John Hodges Deft Do Say they find that John Hodges was dead before ye Capias ad Satisfaciendum above mentioned Issued and by John Hall there fore man all so Say And the afd John Johnson prays Judgment on the Verdict afd Therefore it is Considered by the Court here vizt. This Twenty third day of March Anno Domini one Thousand Seven hundred and - Sixteen That the afd Plt George Hill take nothing by his writ of Sciri facias afd But that he and his pledges of prosecuteing be in mercy and that William Glanvill afd Special baile of the afd Deft John Hodges go thereof without day And also that the afd William Glanvill do Recover against the afd Plt George Hill the Sume of Eight hundred Seventy and Two pounds of Tobacco Cost About his defence in~ this behalfe laid out and Expended according to the forme of the Statute &ca Jams Smith Clk M.r Henry Lowe Junr. takes his place and Sits on the bench also Mr. John March Mr. William Comegys being an Evidence to a power of attorney Philip Eilbeck to his wife Lydia proves he See the Same Signed Sealed and delivered for the uses therein Contained Likewise Mr Samuel Wickes being an Evidence to the Same Power |
