   twelve pounds Currant money afd & thereupon he brings this Suite &ca.
                          Jams Earle pr Querr pledges &ca. John Doe Richd Roe .
   And the afd Plt. by his attry afd prays that the Said Deft~ to his Decln
   afd may answer
      And the Said Deft~ having not filed any plea to the afd Declaration
   This Court gives rule to the Said Deft to file a plea to the afd Accon by the last
   day of the Court other wise Judgment to be Rendered for want of the Same.
   And now at this day vizt. this Twenty Third day of March Annoque
   Domini one Thousand Seven hundred and Sixteen the rule given as afd
   for the Said Deft to file his plea being out and no plea fild whereby the
   afd Plt may remain against the Said Deft~ without defence Therefore it
   is Considered by the Court here vizt. the Same day last mentioned That the
   afd Plt Amos Garrett Recover against the Said Deft~ Philip Eilbeck as
   well the afd Sume of Thirty three Shillings and Eight pence Currant
   money Damages as also the Sume of Three hundred and Six pounds -
   of Tobacco Cost by the afd Plt about his Suite in this behalfe expended
   and by the Court here of his assent adjudged and that the Said Deft~ be~
   taken into Custody

   County in the province aforesaid Tayler was Summoned to answer unto
   Richard Smithers and Mary his wife late called Mary Carvill Execrx. of the -
   last will & Testament of John Carvill late of Kent County Gent deceased of —
   a plea that he render to them the Just and full Sume of one Thousand pounds of
   Sound bright Merchantable neat leafe Tobacco clear of ground leaves & all
   other trash every way well qualified and in good well Seasoned Casque to Contain
   the Same of the value of one hundred and twenty Shillings Sterling money which
   he unjustly detains And whereupon the afd Plts by Thomas Bowne their attry
   Say that whereas ye afd Deft the fourteenth day of February Anno Domini—
   Seventeen hundred and Eight at S.t Pauls Parish in Kent County afd within the
   Jurisdiciõn of this Court by his Certain writing obligatory which the Said Deft~.
   in the life time of the Said John Sealed with his Seale and as his deed delivered
   hereinto Court brought ye date whereof is the Same day & year afd Granted -
   himselfe to owe and be Indebted to the afd John in his life time in the afd
   Just & full Sum of one Thousand pounds of Tobacco of the value of Eighty
