   161                                  March Court 1716
   Said Ebenezer was forced to pay as by the Records of the Said County  
   may appear but also divers Sums of money amounting to three
   pounds Nine Shillings Costs of Suite and divers other Sumes of —
   money in and about the defence of the Said Suite was compelled to
   expend and lay out And whereas the Said Philip Eilbeck was by
   a writ of Capias issuing out of the Court of Comon pleas holden for the
   Said County of Chester in Pensilvania afd the first day of May in the
   year of our Lord one Thousand Seven hundred & thirteen arrested
   at the Suite of a Certain Carpenter Lillingston for the Sum of Six
   Pounds ten Shillings and the Said Jonas Sandeland at the Special
   Instance & request of the Said Philip became Special baile for the Sd
   Philip in the Said County Court before the Justices of the Said County
   Court in the Said County of Chester in Pensilvania in the Parish of
   S.t Pauls in the County of Kent in Maryland afd the Said Philip -
   Eilbeck then and there upon himselfe assumed and to the Said Jonas
   of and from the payment of the Said Six pounds tenn Shillings would well
   & truly Save & keep harmless & endempnified Nevertheless the afd Philip
   his promise and assumption afd in form last mentioned made little
   minding or regarding but plotting & fraudulently intending the
   Said Jonas in this behalf craftily & Subtilly to deceive & defraud
   the Said Six pounds tenn Shillings to the Said Carpenter hath not~
   paid nor the Said Jonas hath not Saved harmless or indempnified
   altho to do the Same the first day of July in the Year last menconed
   hath been thereunto required by which & for that the Said Six pounds
   tenn Shillings were not paid to the Said Carpr or any other for his
   use the Said Carpr the Twenty Sixth day of May in the Year of—
   our Lord one Thousand Seven hundred & fourteen at ye County of Chestr.
   in the Province of Pensilvania in the Court of Comon pleas holden
   for the Said County before the Justices of the Said County So farr
   prosecuted the Said plea that the Said Jonas not only the Said Six
   pounds tenn Shillings but five pounds fifteen Shillings and eleaven
   pence Costs of Suite as by the Record here in Court may appear and.
   divers other Sums of money in and about the defence of the Said -
   Suite was forced to Expend & lay out to the damage of the Said Jonas
   forty pounds Currant money of America and thereupon- he brings
