                                         June Court 1715
   Merchantable Bright Tobacco picked & culled clear from all dull & Spotted
   moultered trashey & ground leaves in well Seasoned Cask to containe ye -
   Same of ye afd value of Seventy three pounds twelve Shillings & tenn
   pence Sterling money for ye well & true payment of ye full & just Summ
   of Eight Thousand Eight hundred & thirty Seven pounds of Tobacco qua:
  :lified as afd in well Seasoned cask to containe ye Same of ye value of
   thirty Six pounds Sixteen Shillings & five pence Sterling money to the
   afd Plt his Exrs & Adm.rs or Assignes upon the tenth day of 8.ber next
   Ensueing ye date of of ye Said Bill in Sasafrax River And the Said Plt~.
   in deed Saith that ye afd Deft~ hath not paid to him ye Same Plt~ ye
   afd Eight Thousand Eight hundred & thirty Seven pounds of Tobacco —
   upon ye afd tenth day of 8.ber which to him at or upon ye Same day he :
   ought to have paid according to ye forme & Effect of ye afd Bill by
   which accõn hath accrued to ye Same Plt to Exact & have of ye afd Deft.
   ye afd Seventeen thousand Six hundred Seventy & four pounds of Tobacco
   in Cask qualified as afd Yet ye afd Deft~ although often required the
   afd Seventeen Thousand Six hundred Seventy & four pounds of Tobacco —
   to ye Said Plt~ ye value of ninety pounds Sterling money & thereupon the
   brings Sute &ca—     TBowne pr Quer. Pledg &ca. Jno Doe & Rd Roe .
   And the Said Deft being Called Came and in his proper person~
   appeared to the above accon . And Saith that he cannot gainsay ye.
   accõn afd of him the Said Richard Bennett nor but that the writeing
   obligatory above mentioned is his act and deed and is willing that —
   Judgment Shall be entred for the Same and Cost thereon accrueing —
   Therefore it is Considered by the Court here viz.t this twenty Seventh
   day of June Anno Domini one Thousand Seven hundred and -
   fifteen that. the Said Plt Richard Bennett Recover against the
   Said Deft. Lutenor Middleton as well the Sume of Seventeen Thousand
   Six hundred Seventy four pounds of Tobacco the Debt afd as also the
   Sume of three hundred Eighty nine pounds of Tobacco Cost by ye
