   refuse to Admitt of that averment as formerly they pray Judgment and that ye afd Plt. may
   be barred from haveing his Accõn afd against him and of this he puts himselfe on~
   ye Court   Fran Cooke
     The Promises afd being read & argued and mature deliberation being by ye Court-
   thereupon taken   And being willing to be farther advised ye Same Cause is by the
   Court Continued untill next Court In course
        Att which Said next Court viz.t this Second day of June Annoque Domini
   one Thousand Seven hundred and fourteen the Same Cause Standing for tryall
   Came the Said Plt by Thomas Bowne his attry and the Said Deft by Francis
   Cooke his attorney.   and the afd Plea & Demurrer being Againe Read and this
   Court being fully advised The Said Plea is adjudged to be insufficient in Law
   to hinder ye Said Plt from maintaining his Accõn Afd And that the Demur.r
   afd is good in Law. Therefore it is Considered by the Court here viz.t this
   Second Day of June Annoque Domini one Thousand Seven hundred and
   fourteen That the Said Plt Thomas Macnemara Recover against the Said Deft.
   David Young   as well the afd Sume of Three Thousand two hundred pounds of -
   Tobacco Damages by the Said Plt on Acco.t of ye Said Mary Pope her not perform
  :ing her promise and Assumpcon afd Sustained and also the Sume of five Hundred
   & four pounds of Tobacco Costs by the Said Plt about his Suite in this behalfe .
   Expended and by the Court here of his assent adjudged against the goods and
   Chattells of the Said Mary Pope in the hands of the Said David to be Administred
   And ye Said Deft in mercy &ca ——
        and the Said Plt Comes into Court by his afd attry and Saith that the Cost
   abovesd Amounting to the Sume of five Hundred & four pounds of Tobacco —
   he doth Release the Said Deft therefore~ —

|   This being an Accõn of Debt for the Sume of Two —
   Her Majtie & Jno Hall | Thousand pounds of Tobacco Standing on the Tryal.
                at | Dockett   But   the Plt Doth make Default and
   Isaac [Tussie?] -         | doth not prosecute the Same Therefore it is —
   ordered by the Court here That the Said Deft go thereof without Day and
   that ye Plts take nothing by there writt afd
