                                    March Court 1715
   his attry afd prays that y.e Deft~ afd to his Decln afd may -
   Answer
     And the afd Thomas by John Roberts his attry comes &
   defends the force & Injury when &ca. And Saith that ye afd .
   Nath.l his accõn afd thereof against him to have or maintain
   ought not because he Saith that he the Said Thomas in &
   upon the Said twentieth day of Novemb.r hath paid the Said
   Sume of two pounds one Shills & five pence & the Said two . .
   thousand Seven hundred & Eighty one pounds of Tobacco in the
   Condition above menconed which to him at the Same day
   ought to have paid according to the form & effect of the Said Condicõn
   viz.t at the Parish of S.t Pauls in the County of Kent within ye Jurisdicõn
   of this Court And this he is ready to verifie wherefore he prays
   Judgment if the Said Nathaniel his Accõn agst. him to have or
   ought to maintain &ca Jno Roberts.
     And the afd Plt by his afd Attry Saith that he by any thing
   by the afd Deft above in pleading alleadged from haveing and
   maintaining his Accõn afd to be barred ought not because he Saith
   that the Said Deft~ upon the afd twentieth day of 9.ber did not pay the
   Said Sume of two pounds one Shillings & five pence and the Said
   two Thousand Seven hundred and Eighty one pounds of Tobacco -
   in the Condition above mentioned and this he prays may be~
   Inquired of by the Country &ca.    TBowne pr Querr ——
     And the Defendant in like manner Roberts pr Deft~.
   Command was therefore given to the Sherf of Kent County
   that he imediately cause to come here twelve &ca. By whome
   &ca. who neither &ca. to Recognize &ca. Because as well &ca. And the
   Sherf of Kent County comes and makes return that he hath here
