   James Smith of ye afd Coty of a plea of Trespass upon the Case And th[at]
   he have then and there the Said writ &ca.
      Att w.ch Said next Court vizt. this fifteenth day of November ye Same
   yeare afd the day of return of Said writ Came William Frisby Gentl.
   high Sherf of Said County and made returne thereof in these words
   thereon endorsed as folls viz Non Est Inventus pr W:m Frisby Sherf —
   And A Short note being fild when Said writ Issued forth and a Copy
   thereof left at the last place of ye Defts abode Expressing the true cause
   of accõn wch. foll vizt. Kent County In Maryland Ss James Smith Plt
   agt. Daniel Maggs Deft~. Trespass upon the Case The true Cause
   of Accõn is that the Said Deft~ Stood indebted unto the Said Plt~ the
   Sume of Three hundred and Sixty Six pounds of Tobacco it being
   on Accõn between the Said Daniel and ye Said James as also the.
   Said Deft~ Stood indebted unto ye Said Plt~ on Accompt and rest due
   to ye Said Plt~ on ballance ye Same Accompt the Sume of thirty four
   Shillings and three pence halfe penney as pr acco.t~ hereunto annext
   and in Court ready to be produced may more at large appeare the —
   w.ch two Sumes are due unto the Said James and hath not Recd —
   Satisfaccõn for the Same for w.ch the Said Plt~ prays that an Attach
